Acceptance

By placing an order or creating an account at babocarriers.com, you accept these terms. If you do not, please do not transact with us.

Products

We make every effort to display accurate product colours and descriptions. Slight variations in fabric tone are within standard textile manufacturing tolerance.

Pricing and payments

Prices are displayed in your local currency: AUD, USD, GBP, CAD and NZD. We accept Visa, Mastercard, Amex, Apple Pay, Google Pay, Shop Pay and Afterpay where available. Payment is captured at order placement.

Use of the carrier

The Bonding Carrier is intended for the ages and weights specified: 3.5 to 12 kg, newborn through approximately 24 months. Misuse, including water immersion, motorbike use or carriage of animals, voids the warranty and is not recommended. Please read the in-box safety insert and the How to Wear page before your first carry.

Liability

To the maximum extent permitted under applicable consumer protection law, our liability is limited to the price of the carrier. Statutory rights and warranties remain unaffected.

Customs, import duties and import taxes

Where this applies. Where your order is shipped to you from outside your own country, it crosses a customs border and this clause applies. Where an order is fulfilled from stock inside your country, no import charges arise and nothing in this clause applies to it.

Delivery basis. Cross-border orders are shipped DAP (Delivered At Place) under Incoterms 2020: we arrange and pay for carriage to your delivery address, and import clearance and the import charges are yours.

Ownership and risk. Risk of loss or damage in transit stays with us until the goods are delivered into your physical possession.

What your payment covers. The total you pay at checkout covers the goods, the delivery charge shown, and any sales tax, VAT or GST we are required by law to charge at the point of sale. It does not cover customs or import duty, import VAT or GST charged at the border, or customs clearance, brokerage or handling fees charged by the carrier. Where those apply they are charged to you separately, normally by the carrier before delivery. We do not collect them and receive no part of them.

Tax collected at the point of sale. Where the law requires us to charge local sales tax, VAT or GST on your order, it is included in, or identified within, the total you approve before payment. That is a tax on the sale, not a prepayment of import duty or import VAT.

You are the importer. A cross-border order is declared for import in your name as the consignee, for your own personal use, and the import charges are yours. Please make sure your name and delivery address are complete and correct, and respond promptly if the carrier asks you for information needed to clear the parcel.

We cannot quote the amount. Duty and tax rates and value thresholds are set by your government and change without notice. Please check with your national customs authority if you need certainty before ordering.

If the charges are not paid. If the parcel is returned to us, we will refund the price of the goods and the standard delivery charge you paid, less the actual cost we are charged for the return, which we will evidence to you. If it is destroyed or abandoned, contact us and we will resolve it under our Refund Policy.

Refunds and duties. We refund what you paid us. Import duty and taxes were paid to a carrier or customs authority, not to us, so we cannot refund them directly; depending on your country they may be reclaimable from your customs authority, and we will provide the documents you need. If goods arrive faulty, damaged or incorrect, we will also reimburse the import charges you paid on them against proof of payment.

Your statutory rights. Nothing in these Terms reduces or removes rights you have under the consumer law of the country where you live that cannot be excluded by agreement. Whatever governing law is stated elsewhere in these Terms, if you are a consumer you keep the benefit of the mandatory consumer protection rules of your country of residence, and you may bring proceedings in your local courts where the law of that country gives you that right.

Governing law

These terms are governed by the laws of the State of Wyoming, United States. Statutory consumer rights in your country of residence, including the Australian Consumer Law and equivalent statutes in New Zealand, the United Kingdom and Canada, remain unaffected.
